Background In the EU, clinical assessors, rapporteurs and the Committee for Medicinal Products for Human Use are obliged to assess the ethical aspects of a clinical development program and include major ethical flaws in the marketing authorization deliberation processes. To this date, we know very little about the manner that these regulators put this obligation into action. In this paper, we intend to look into the manner and the extent that ethical issues discovered during inspection have reached the deliberation processes. (...) Methods To gather data, we used the Dutch Medicines Evaluation Board database and first searched for the inspections, and their accompanying site inspection reports and integrated inspection reports, related to central marketing authorization applications of drugs submitted to the European Medicines Agency from 2011 to 2015. We then extracted inspection findings that were purely of ethical nature, i.e., those that did not affect the benefit/risk balance of the study. Only findings graded at least major by the inspectorate were included. Lastly, to identify how many of the ethically relevant findings reach the application deliberation processes, we extracted the relevant joint response assessment reports and reviewed the sections that discussed inspection findings. Results From 2011 to 2015, there were 390 processed applications, of which 65 had inspection reports and integrated inspection reports accessible via the database of the Dutch Medicines Evaluation Board. Of the 65, we found ERFs in 37. The majority of the ERFs were graded as major and half of the time it was informed-consent related. A third of these findings were related to research ethics committee processes and requirements. Of the 37 inspections with ERFs, 30 were endorsed in the integrated inspection reports as generally GCP compliant. Day 150 joint response assessment reports and Day 180 list of outstanding issues were reviewed for all 37 inspections, and none of the ERFs were carried over in any of the assessment reports or list of outstanding issues. Conclusion None of the ethically relevant findings, all of which were graded as major or critical in integrated inspection reports, were explicitly carried over to the joint assessment reports. This calls for more transparency in EMA application deliberations on how ERFs are considered, if at all, in the decision-making processes. (shrink)

We believe that “caching” a baby would have been too great a danger in human prehistory, and thus could not serve as the context for prelinguistic vocalization. Rather, infants were most likely carried at all times. Thus, the question arises of why the cry of an infant is such a loud vocalization.

Koonin, in an article in this issue, claims that CRISPR–Cas systems are mechanisms for the inheritance of acquired adaptive characteristics, and that the operation of such systems comprises a “Lamarckian mode of evolution.” We argue that viewing the CRISPR–Cas mechanism as facilitating a form of “directed mutation” more accurately represents how the system behaves and the history of neoDarwinian thinking, and is to be preferred.

Much research in the field of emotions has shown that people differ in the cues that they use to perceive their own emotions. People who are more responsive to personal cues (personal cuers) make use of cues arising from their own bodies and behavior; people who are less responsive to personal cues (situational cuers) make use of cues arising from the world around them. An evolutionary explanation of this well-documented phenomenon is that it occurs because of the operation of a (...) cognitive module designed to enable the organism to predict its own impending behavior. This theory suggests that situational cuers would be people for whom external factors are the best source of information about their own future behavior, whereas personal cuers are people for whom cues about themselves are the best source of information about their own future behavior. Such a view is founded in the New Realist philosophy of the early twentieth century, a philosophy that affected psychology through the work of E. C. Tolman and J. J. Gibson. (shrink)

We investigate how the perceived uncertainty of a conditional affects a person's choice of conclusion. We use a novel procedure to introduce uncertainty by manipulating the conditional probability of the consequent given the antecedent. In Experiment 1, we show first that subjects reduce their choice of valid conclusions when a conditional is followed by an additional premise that makes the major premise uncertain. In this we replicate Byrne. These subjects choose, instead, a qualified conclusion expressing uncertainty. If subjects are given (...) a third statement that qualifies the likelihood of the additional premise, then the uncertainty of the conclusions they choose is systematically related to the suggested uncertainty. Experiment 2 confirms these observations in problems that omit the additional premise and qualify the first premise directly. Experiment 3 shows that the qualifying statement also affects the perceived probability of the consequent given the antecedent of the conditional. Experiment 4 investigates the effect of suggested uncertainty on the fallacies and shows that increases in uncertainty reduce the number of certain conclusions that are chosen while affirming the consequent but have no effect on denying the antecedent. We discuss our results in terms of rule theories and mental models and conclude that the latter give the most natural account of our results. (shrink)

ObjectiveTo apply a socioecological approach to identify risk and protective factors across levels of the “sports-ecosystem,” which are associated with mental health outcomes among athletes in para-sports and non-para sports. A further aim is to determine whether para athletes have unique risks and protective factor profiles compared to non-para athletes.MethodsA cross-sectional, anonymous online-survey was provided to all categorized athletes aged 16 years and older, registered with the Australian Institute of Sport. Mental health outcomes included mental health symptoms, general psychological distress, (...) risky alcohol consumption and eating disorder risk. Risk and protective factors across multiple levels of the socioecological model, including individual, microsystem, exosystem and macrosystem level factors were assessed via self-report.ResultsA total of 427 elite athletes participated in the study. No significant differences in the rates of mental health problems were observed between para and non-para athletes. Both differences and similarities in risk and protective factor profiles were found across the multiple levels of the sports-ecosystem. Weak evidence was also found to support the hypothesis that certain risk factors, including experiencing two or more adverse life events in the past year, sports related concussion, high self-stigma, inadequate social support and low psychological safety conferred a greater risk for poorer mental health outcomes for para athletes in particular.ConclusionRisk factors occurring across various levels of the sports ecosystem, including individual, interpersonal and organizational level risk factors were found to be associated with a range of poorer mental health outcomes. The association between mental ill-health and certain risk factors, particularly those at the individual and microsystem level, appear to be greater for para athletes. These findings have important implications for policy and mental health service provision in elite sports settings, highlighting the need for more nuanced approaches to subpopulations, and the delivery of mental health interventions across all levels of the sports ecosystem. The purpose of this study was to determine the development of moral judgement in first-year and senior baccalaureate nursing students. These students were enrolled in three separate nursing programmes, each of which differed significantly in ethical content. The sample totalled 180 students enrolled in three New England programmes. Programme A included an ethics course taught by a professor of ethics. Programme B integrated ethical issues into all nursing theory courses. Programme C did not include ethical content in theory courses. The (...) design was of a developmental cross-sectional study. The dependent variable was the development of moral judgement, as measured by Rest’s Defining Issues Test. The independent variable was the amount of ethics taught in the nursing programmes and the level of academic education. The senior nursing students from programme A scored significantly higher than the other senior groups on the Defining Issues Test. The conclusion is that an ethics course with group participation and a decision-making element significantly facilitated nursing students’ development of moral judgement. (shrink)

In recent years, there has been a growing interest in the relation between Marxism and the Soviet productivist economy. While historical scholarship rarely explores the intellectual context in which the Soviet experiment unfolded, ecomarxists tend to describe the Soviet Union’s mistaken path as a result of the loss of ‘metabolic’ thinkers following the rise of Stalin. This article challenges the neat, purported divide between a ‘metabolic’ and ‘productivist’ Marxism by analysing the energy-economic thinking of Gleb M. Krzhizhanovskii, a Bolshevik engineer (...) and old friend of Lenin. As chairman of both the electrification commission (GOELRO) and the State Planning Commission (Gosplan), Krzhizhanovskii conceptualised the energy economy as something embedded in the metabolism of nature and society and as the technical-economic basis of the socialist economy. This argument drew its strength from his idea that production is part of the general, ongoing life-process, and the hope that large-scale electrification and electro-chemistry could help govern the metabolism between nature and society more rationally – both arguments commonly found among contemporary natural scientists. Any ecomarxist attempt to recover the concept of metabolism today has to come to terms with its productivist and technocratic history. (shrink)

Nicolas Gueudeville's 1715 French translation of Utopia is often dismissed as a “belle infidèle,” an elegant but unfaithful work of translation. Gueudeville does indeed expand the text to nearly twice its original length. But he presents Utopia as a contribution to emergent debates on tolerance, natural religion, and political anthropology, directly addressing the concerns of many early advocates of the ideas we associate with Enlightenment. In this sense, it is not as much an “unfaithful” presentation of More's project as it (...) is an attempt to introduce Utopia to eighteenth-century francophone audiences—readers for whom theses on political economy and natural religion were much more salient than More's own preoccupations with rhetoric and English law. This paper introduces Gueudeville and his oeuvre, paying particular attention to his revisions to Louis-Armand de Lom d'Arce, Baron de Lahontan's 1703 Nouveaux Voyages dans l'Amérique Septentrionale. Published in 1705, Gueudeville's “revised, corrected, & augmented” version of Lahontan's Voyages foregrounds the rational and natural religion of the Huron as well as their constitutive aversion to property, to concepts of “mine” and “yours.” Gueudeville's revised version of Lahontan's Voyages purports to be an anthropological investigation as well as a study of New World political economy; it looks forward, moreover, to his edition of Utopia, framing More's work as a comparable study of political economy and anthropology. Gueudeville, in other words, renders More's Utopia legible to Enlightenment audiences, depicting Utopia not in terms of impossibility and irony but rather as a study of natural religion and attendant forms of political, devotional, and economic life. Gueudeville's edition of Utopia even proved controversial due, in part, to his insistence on the rationality as well as the possibility of Utopia. (shrink)

Philosophers often identify needing something with requiring it to avoid harm. This view of need is roughly accurate, but no adequate analysis of the relevant sort of requirement has been given, and the relevant notion of harm has not been clarified. Further, the harm-avoidance picture must be broadened, because we also need what is required to reduce danger. I offer two analyses of need (one probabilistic) to address these shortcomings. The analyses are at a high level of generality and accommodate (...) our ordinary notion of need as well as narrower conceptions. I also explain why the only extant, detailed modal account of need, David Wiggins’s (1987/1998), is inadequate. My analyses imply that to have a need for something is to have the (expected) quality of one’s life depend counterfactually on it in a certain way. Flew' s reservation about my assertion that the Enquiry contains no significant revision of the Treatise conception of geometry as a body of necessary and synthetic knowledge, appears to involve two charges. Firstly, he alleges that I dismiss but offer no substantial argument against his own view that the Enquiry restores (...) pure geometry "to its place alongside the other two elements of the trinity ". Secondly, he thinks that I have committed a serious sin of omission in failing to take into consideration a certain passage in the Enquiry (page 31, section 27) which, in his opinion, constitutes "a quite decisive reason" for supposing that Hume abandoned the Treatise position, in that it contains an account of applied mathematics, a subject on which the Treatise is silent. To the charge of omission I plead guilty, and I shall presently seek to remedy this defect and to state why I do not share Flew' s view of the significance of the said passage. To the former charge I am not so ready to plead guilty, and I shall counter-charge that Flew has failed not only to do justice to my proposed reading of Enquiry page 25, section 20, but also to provide clear and convincing support for his own. One difficulty encountered in answering Flew lies in understanding whether or not his claim about the status of geometry as a pure science in the Enquiry is put forward independently of his interpretation of E31. As originally presented in Hume's Philosophy of Belief this appears to be the case, and if so, on what evidence does it rest? 2 In his book, Flew' s statement about Hume replacing pure geometry alongside arithmetic and algebra follows directly upon a paragraph in which he comments that Hume's references to geometrical propositions at E25 signify "an important advance from the position of the Treatise". For whereas the status of perfect precision and certainty was 67. there withheld from geometry (T71), Hume now speaks of the certainty and evidence of the propositions of Euclidean geometry, and declares such propositions to be discoverable by the mere operation of thought, without dependence on what is anywhere existent in the universe. (E25) Now, I argued at some length in my paper (pp. 21-24) that Hume is prepared to grant scientific status to geometry in the Enquiry because he has come to regard its certainty as that proper to a mathematics of space. In this commentary on Eva Feder Kittay's Love's Labor: Essays on Women, Equality, and Dependency, I focus on Kittay's dependency theory. I apply this theory to an analysis of women's inadequate access to high-quality, cost-effective healthcare. I conclude that while quandaries remain unresolved, including getting men to do their share of dependency work, Kittay's book is an important and original contribution to feminist healthcare ethics and the development of a normative feminist ethic of care.

Goodman'snew riddle of induction can be characterized by the following questions: What is the difference between grue and green?; Why is the hypothesis that all emeralds are grue not lawlike?; Why is this hypothesis not confirmed by its positive instances?; and, Why is the predicate grue not projectible? I argue in favor of epistemological answers to Goodman's questions. The notions of lawlikeness, confirmation, and projectibility have to be relativized to (actual and counterfactual) epistemic situations that are determined by the available (...) background information. In order to defend this thesis, I discuss an example that is less strange than the grue example. From the general conclusions of this discussion, it follows that grue is not projectible in the actual epistemic situation, but it is projectible in certain counterfactual epistemic situations. Contemporary analyses of moral injury in war focus on its occurrence in American veterans who commit or witness acts contrary to their deeply held moral beliefs. Moral injuries suffered by noncombatants are largely absent from this discourse. I advocate for greater inclusion of the victim‐centered perspective in studies of moral injury in war. This perspective conceptualizes moral injury as the specific harm suffered when one's moral humanity is not recognized. Given that susceptibility to moral injury is part of moral personhood, (...) failure to acknowledge noncombatants' moral injury represents failure to recognize their full and particular personhood and thus may inflict further moral injury. Centering noncombatants' moral injury strengthens the critical power of moral injury, enabling the identification of specific steps toward establishing just relationships and social trust to repair and prevent moral injury in noncombatants and combatants alike. Nelson, Russ Paul's letter to the Romans highlights the significance of volunteers to the mission of Jesus in the church. Acts 18 introduces a married couple, Priscilla and Aquila, late of Rome and now of Corinth. Initially they house and employ Paul, thereby giving voluntary service to Paul. Priscilla and Aquila's generosity remains a feature of contemporary Catholicism, clearly identifiable in the parishes. As an everyday part of church life, volunteering is worthy of recognition and nurture. Contemporary ministers might (...) reflect on the development of Priscilla and Aquila as volunteers as first mentioned in the Acts of the Apostles. Perhaps these two lay people were instructed by Paul around the meal table during the eighteen months they were together. The U.S. Food and Drug Administration's rationale for supporting the development and approval of BiDil for heart failure specifically in black patients was based on under-powered, post hoc subgroup analyses of two relatively old trials , which were further complicated by substantial covariate imbalances between racial groups. Indeed, the only statistically significant difference observed between black and white patients was found without any adjustment for potential confounders in samples that were unlikely to have been adequately randomized. Meanwhile, because the accepted (...) baseline therapy for heart failure has substantially improved since these trials took place, their results cannot be combined with data from the more recent trial amongst black patients alone. There is therefore little scientific evidence to support the approval of BiDil only for use in black patients, and the FDA's rationale fails to consider the ethical consequences of recognizing racial categories as valid markers of innate biological difference, and permitting the development of group-specific therapies that are subject to commercial incentives rather than scientific evidence or therapeutic imperatives. This paper reviews the limitations in the scientific evidence used to support the approval of BiDil only for use in black patients; calls for further analysis of the V-HeFT I and II data which might clarify whether responses to H-I vary by race; and evaluates the consequences of commercial incentives to develop racialized medicines. We recommend that the FDA revise the procedures they use to examine applications for race-based therapies to ensure that these are based on robust scientific claims and do not undermine the aims of the 1992 Revitalization Act. This article offers an account of settler witnessing of residential school survivor testimony that avoids the politics of recognition and the pitfalls of colonial empathy. It knits together the concepts of bearing witness, Indigenous storytelling, and affective reckoning. Following the work of Kelly Oliver, it argues that witnessing involves a reaching beyond ourselves and responsiveness to the agency and self-determination of the other. Given the cultural genocide of residential schools, responsiveness to the other require openness to and nurturing of Indigenous (...) ways of knowing and being. In order to illustrate the complexities and challenges of settler witnessing, the author reflects on her experiences in attending six of the TRC’s national events and, in particular, what she has learned from Frederick “Fredda” Paul, Passamaquoddy Elder, healer, storyteller, and residential school survivor. The article analyzes aesthetics and emotions in the staging of TRC events and making meaning over time and the temporality of transitional justice. (shrink)

Demographic differences among consumer groups have become increasingly important to the development of marketing strategies. Marketers depend heavily on the sales force to implement strategies at the consumer level and, not surprisingly, different groups may view the salesperson’s role differently. Unfortunately, unethical sales practices targeted at various consumer groups, and especially at seniors, have been utilized as well. The purpose of this study is to provide initial empirical evidence of the ethical ideological make-up of four age segments outlined by Strauss (...) and Howe (1991, Generations: The History of America’s Future 1584–2069, Morrow, New York) and to examine the propensity for these groups (seniors, in particular) to respond differentially to potentially unethical sales tactics. Data were collected from 179 respondents representing the four generational age groups. MANOVA revealed that the seniors in this study were distinct with respect to ethical ideology and less accepting of unethical sales tactics. Managerial implications are discussed for sales organizations to maximize their effectiveness across consumer groups. (shrink)

Eagle) Miriam Grace Monfredo's feminist genre fiction, her "historymystery " series featuring nineteenth-century librarian Glynis Tryon, offers an opportunity to find a way ofreading literary texts that is not only feminist, but also Girardian. Girard's work provides two clear ways to construct feminist readings directly, without the mediation of overtly feminist theory. First ofthese is Girard's respect for the "quasi-theoretical" potential of literary texts, especially some of those which attend to apparently trivial matters. In Deceit, Desire and the Novel, Girard argues that (male) novelists offer insights unavailable elsewhere, including those scientific fields that claim to know more than everyone else. In its valuing of questions about snobbism, for example, Deceit, Desire and the Novel offers a woman-friendly model. The (male) novelist's question about snobbism is "too frivolous" for (men of) science, but Girard argues that "in his probe of snobbism the novelist is asking himself in his own way just what Rosemary Erickson Johnsen59 might be the hidden springs that make the social mechanism tick" (220). While I regret the fact that Girard's examples and language often ignore women, I believe his conviction that attention to matters socially coded as superficial and frivolous can produce great insight is one feminist critics can appreciate. The second Girardian tool feminists can rely upon is the method of reading texts of persecution described in The Scapegoat. Girard suggests how we might read texts ofpersecution written by naive persecutors in ways that identify with the persecuted and gather the information unintentionally supplied by the authors: "I call those persecutors naive who are still convinced that they are right and who are not so mistrustful as to cover up or censor the fundamental characteristics of their persecution. Such characteristics are either clearly apparent in the text and are directly revealing or they remain hidden and reveal indirectly" (8). Monfredo's crime novels, set in the mid-nineteenth century and focusing on such disenfranchised groups of citizens as women, slaves, Native Americans, and free African-Americans, depend for their verisimilitude on her ability to read historical sources and literary predecessors in just such a way. Accuracy requires that Monfredo's works be categorized as feminist historical crime novels, however awkward such a lengthy description may be. Her novels observe the principles not only of both genres—historical fiction and detective fiction—but also the political position offeminism, and they meet these multiple demands with considerable skill. Furthermore, resolution in crime fiction depends upon the law; working within that tradition, Monfredo is called upon to seek solutions within the system, to look for justice as the result ofa proper functioning ofthe legal and social systems. Information gathered, whether by the official representatives ofthe law or by amateurs, is turned over to the authorities. While her novels clearly respect that tradition, they also point out some limits to the judicial system's ability to contain violence. Girard's model ofits functioning, as described in Violence and the Sacred, depends upon an equality that whole segments of the society Monfredo is depicting do not in fact enjoy: "The judicial authority is beholden to no one. It is thus at the disposal ofeveryone" (23). Ifwomen cannot own property, enter into contracts or sit on juries, in what sense is the law at their disposal? Taking sexuality and affect as its focus, this article leads us into the uncharted terrain of ‘outlawed affects’, those unspeakable sensations that do not fall easily into established categories and yet meddle with social relations. They are in this sense ‘open secrets’. The article explores some of the challenges for feminist methodology in representing the space where affective and other needs meet in the context of the cultures of labour organizing in the factory communities on Mexico’s northern border.

This paper examines what managers ought to do when confronted with apparent moral conflicts between their managerial responsibilities and the general requirements of morality, specifically when those conflicts are driven by the institutional environment. I examine Google’s decision to enter the Chinese search engine market as an example of such a conflict. I consider the view that Google’s managers engaged in justifiable moral compromise in making the choice to engage in self-censorship and show how this view depends on the idea (...) of genuine moral dilemmas or irresolvable moral conflicts. I argue that there are serious reasons to doubt the existence of genuine moral dilemmas both in the abstract, as well as in the context of managerial responsibility. I propose an alternative account for what Google’s managers ought to do, as well as others who face relevantly similar situations. The account contains two conditions for permissibly contributing to another party’s failure to live up to their moral responsibilities. The first condition is that the manager must intend and act in such a way as to minimize the firm’s complicity in the other entity or actor’s failure, which in most cases will imply a duty for the manager to take actions that aim towards changing the institutional context. Under the second condition, managers ought to communicate to the firm’s constituents that they take seriously the importance of the interests at stake. (shrink)

This paper examines how the oncomouse became a patentable invention. The oncomouse began life in the laboratory, where it was genetically modified for use as a research tool to assist with the study of human cancer. Its design, a product of genetic modification, made the oncomouse potentially patentable subject matter. The United States was the first jurisdiction to award the patent and several others followed. However, the question of animal patenting was most contentious in Europe and Canada. In this paper (...) I examine debates about animal patenting within the legal and moral spaces created by United States, European and Canadian patent law, focusing on differences that emerged in each case. I argue that oncomouse as a patentable invention was made possible and acceptable as different ways of being mouse as natural animal, research tool and invention were made to cohere: that is as they were made to overlap and depend upon one another. In the paper I use the term "cohere" to describe the logic of animal patenting that emerged with, and was essential to, the outcome in each jurisdiction. I describe an ontological politics of connecting and separating different ways of being mouse, as the oncomouse's genetic modification, risks, benefits, and suffering were juxtaposed with patent law, precedent, laboratory protocols, and understandings of human agency and control. As connections and separations were made, a relation, "natural animal-research tool-invention", was established, and logic of animal patenting emerged: but differently each case. (shrink)

Increases in climate uncertainty and energy costs as well as food, water, and services insecurity are just a few of the challenges driving the growing demand for sustainable design outcomes. Sustainability and Design Ethics provides a systematic value analysis that makes a reasoned argument the rethinking of current design methods and the values and ethics which (...) guide them. Providing context and language, this book delineates the ideas and principles that lie at the foundation of a variety of codes of ethics, and then critically analyzes existing published codes and the practices that stem from them. It takes a practical approach, discussing applied ethics, and relies upon an understanding of the moral reasoning that supports the ideas and professionalism and an ethical standard of care. Drawing on the author's experience as a design professional and his study of business ethics, this book supplies a detailed exposition of the underlying ethical reasoning involved in the challenges confronted by contemporary design professionals. This information can then be distilled into sustainable practices and the corresponding ethics. Sustainability requires design professionals to expand the considerations of design beyond the traditional ethical points of view and to provide a balanced analysis of how a sustainable standard of care might be composed. While other books might cover the environment and design, professional ethics are addressed as an afterthought at most, if at all. And no other book available explores sustainability from a designer’s perspective. My aim in this paper is to determine the conditions under which such acts are Justified. The route I take is through the concept of consent, with actual consent providing the foundation for a rather complex condition which I claim is necessary and sufficient for the Justification (...) of paternalism.Because a paternalistic act apparently violates a subject's right to non-interference, it constitutes a problem in the general area of rights. Ideally, then, one should have a developed and convincing theory of rights — that is, a theory which contains an analysis of the concept of a right, and offers solutions to the central problems, e.g. who has rights and why, what considerations override prima facie rights, and how the relative importance of prima facie rights is determined — from which the solutions to various problems about paternalism can be derived. Our project in this essay is to showcase nonnaturalistic moral realism’s resources for responding to metaphysical and epistemological objections by taking the view in some new directions. The central thesis we will argue for is that there is a battery of substantive moral propositions that are also nonnaturalistic conceptual truths. We call these propositions the moral fixed points. We will argue that they must find a place in any system of moral norms that applies to beings like us, in worlds (...) similar to our own. By committing themselves to true propositions of these sorts, nonnaturalists can fashion a view that is highly attractive in its own right, and resistant to the most prominent objections that have been pressed against it. Teaching bioethics in the new millennium requires its practitioners to confront a wide area of methodological alternatives. This essay chronicles the author's journey from the principlism of Beauchamp and Childress, through narrative and postmodern bioethics, to a complex feminist critique of postmodern bioethics that emphasizes functional human capabilities and the creation of structures that can facilitate free discussion of those capabilities and how best to realize them. Teaching bioethics concerns not only the acknowledgement of differences but also reminding ourselves of (...) our samenesses. Sustained Habermasian democratic conversations might help us to escape the narrow confines of a postmodern bioethics of moral strangers for a richer world of moral friends. (shrink)
